Terms of Use
These Terms govern your use of the Cerfina website and the services offered through it. The site is an informational and marketing platform: trading itself is executed with licensed entities through the platform's connections. By creating an account or using the site you accept these Terms as a contract between you and Cerfina.
1. Use of the website and services
You may use the website and the platform services for their intended purpose: learning about automated trading, opening a personal account and using the tools provided in connection with your own trading activity. You agree to provide accurate registration information, to keep it current, and to use only one account per person unless we have agreed otherwise in writing.
The services are offered to people aged eighteen or over who are legally able to enter contracts. Availability of specific features, payment methods or assets may vary depending on your jurisdiction and the requirements that apply there. Where a service is not available to you, attempting to circumvent the restriction through misrepresentation is a breach of these Terms.
2. Restrictions
You may not resell, sublicense or commercially exploit access to the platform without a written agreement. You may not probe, scan or test the vulnerability of the site or its infrastructure, interfere with other users, or attempt to access accounts, data or systems that are not yours. Automated scraping of the website, and any use of its content to build a competing dataset or service, is not permitted.
These restrictions protect the integrity of a platform that handles other people's money. Where a restriction is unclear, the rule of thumb is simple: use the service as a customer, not as an attacker or a competitor.
3. Marketing materials and communications
By registering you agree to receive service communications: account notices, security alerts, withdrawal updates and similar operational messages. These are not marketing and cannot be switched off, because they protect your account.
Separately, you may choose to receive marketing communications such as market commentary and product news. That choice is yours, presented clearly at signup, and can be withdrawn at any time through your profile or the unsubscribe link in every marketing email. We do not sell your contact details to third parties, and promotional messages always identify who they are from.
4. Intellectual property
The Cerfina name, logo, website design, text, illustrations, software and the platform's proprietary analysis systems are protected by intellectual property law. You receive a personal, revocable, non-exclusive licence to view and use the site and services for their intended purpose, and no other rights are transferred to you.
You may not copy substantial parts of the site, remove branding from outputs, reverse engineer the platform's software, or use our trademarks without permission. Content you publish remains yours: by posting it to the platform you grant us only the licence needed to display it where you chose to display it.
5. Privacy
Our collection and use of personal data is described in the Privacy Policy, which forms part of these Terms. In summary, we collect what the service needs to function, use it for stated purposes only, keep it no longer than necessary and protect it with the measures described on the Security page.
Disagreements about data handling follow the routes in the Privacy Policy, including the right to complain to the Information Commissioner's Office. Disagreements about the service follow the Complaints procedure. The two processes are distinct and one does not replace the other.
6. Links to third-party sites
The platform functions by connecting to third-party venues and services, and the website occasionally links to external resources for your convenience. We do not control those third parties, and their terms, prices, availability and content are their own responsibility. A link is not an endorsement, and a connection to a venue is not a representation about its solvency or regulatory status.
When you leave our domain, you do so under the destination's terms. You should read them where they matter, particularly when moving money. Where we become aware that a linked service is operating dishonestly, we remove the link and say so in the dashboard.
7. Prohibited uses
Beyond the restrictions above, you may not use the platform for unlawful purposes of any kind: laundering the proceeds of crime, financing terrorism, evading sanctions, infringing intellectual property rights, distributing malware, or attacking the site's infrastructure through denial of service or other means. Spam, deceptive trading patterns intended to manipulate venue behaviour, and impersonation of other people or of Cerfina staff are equally prohibited.
Breaches of this section lead to immediate account suspension and, where the law requires it, a report to the relevant authorities. Where funds are frozen as part of such a suspension, their release follows the outcome of the underlying process, not convenience.
8. Support
Support is available Monday to Friday during UK support hours by email to [email protected]. We aim to respond within one working hour, and every message is answered by a person. The scope of support covers the platform, its features, payments and account matters.
Support staff cannot provide personal investment advice, and requests for it will be declined politely. Where a question falls outside support's scope, such as tax treatment of your trading results, we will say so rather than guess.
9. Disclaimers
The website and its content are provided for information purposes. While we take reasonable care to keep content accurate and current, we do not warrant that it is complete, error-free or suitable for your particular situation. Market information, illustrations and examples on the site are indicative, and nothing on it constitutes investment advice, a recommendation, or a promise of results.
Trading involves substantial risk, described plainly on the Risk Disclosure page. Automated tools execute strategies; they do not remove risk or make outcomes certain. You are responsible for your decisions, including the decision to use automation at all.
10. Limitation of liability
To the extent permitted by law, Cerfina's liability for losses arising from use of the website and services is limited to the amount you have deposited to your platform account in the twelve months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses, including lost profits or trading opportunities, or for losses caused by events outside our reasonable control such as exchange outages or force majeure.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud. Your statutory rights as a consumer are unaffected.
11. Indemnity
You agree to indemnify Cerfina against claims, losses and reasonable costs arising from your breach of these Terms, your misuse of the platform, or your violation of any law or third-party right. This indemnity does not apply where the claim arises from our own negligence or wilful misconduct.
If a third party contacts us about your activity, we will notify you where we are legally able to, so that you can participate in resolving the matter rather than learning of it after the fact.
Other provisions
These Terms may be updated from time to time. The current version is always the one published on this page, and it takes effect from publication of the updated version. Material changes are announced in the dashboard; continuing to use the service after a change takes effect means you accept the updated Terms. If a provision is found unenforceable, the remainder stays in force, and the unenforceable provision is replaced by the closest valid equivalent.
These Terms are governed by the laws applicable in the United Kingdom, and disputes follow the escalation route described in the Complaints procedure, including the possibility of referral to the Financial Ombudsman Service where eligible.
